Climate Change - Splits within U.S. Industry Animate the Policy Debate

</div><div>The climate change policy debate has become more ferocious in the U.S., with some energy

companies resigning from the U.S. Chamber because of its perceived reticence to take more

progressive positions.

Mr. Eule, who leads the U.S. Chamber's climate and energy policy lobbying efforts, has been in

the midst of this debate from the start. He will describe the dynamics at work in the U.S. as

climate legislation moves through Congress and what we can expect in the lead up to the

Copenhagen Conference. He will also discuss some of the fault lines in the international

negotiations and how business can play a bigger role. This event will be on the record.

Biography: Prior to joining the U.S. Chamber, Mr. Eule was the director of the Office of Climate

Change Policy and Technology at the U.S. Department of Energy. His prior experience includes a

As enticing as the prospect of complete independence from foreign sources of energy may be, there is no realistic way for the U.S. to achieve this goal, at least in the foreseeable future. Indeed, in today’s globalized economy, complete energy independence may not even be desirable, particularly if it forces reliance on high-cost fuels and strategies that could be better provided by reliable and diversified global energy markets. Moreover, because many energy supplies are traded globally and are fungible, it’s difficult to see how the U.S. can insulate itself totally from sharp swings in global energy markets. 

In an ideal world, our reliance on imported energy would not even be an issue, but the world we inhabit is less than ideal. No one is particularly squeamish about buying oil and natural gas from Canada, Norway, or the United Kingdom because we know that these countries are reliable trading partners that are highly unlikely to use oil as a geopolitical weapon. Well, that didn’t take long. On Monday, after the G77 took a stroll and “Hopenhagen” was feeling more like “Nopenhagen,” there was seemingly a sliver of good news in the technology discussions. While almost mind-numbingly technical, these talks are nonetheless of particular interest to the business community, so we follow them quite closely. The good news was that from 31 pages, the technology co-chairs (from Trinidad & Tobago and Japan) were able to produce a text of just four pages . What’s perhaps most significant about the text was what was missing—any mention of intellectual property. In this case, no news really was good news.</p><p style="margin: 0px 0px 1em; padding: 0px; border: 0px; outline: 0px; vertical-align: baseline; color: rgb(86, 86, 86); background: transparent;">But barely had the ink dried on the new text when an even newer 11-page text was released this morning (Tuesday) containing about half a dozen bracketed options covering the usual IP litanty, such as compulsory licensing, technology pools, outright confiscation, and the like, that threaten to kill the goose—innovation—that lays the golden eggs—advanced technologies.</p><p style="margin: 0px 0px 1em; padding: 0px; border: 0px; outline: 0px; vertical-align: baseline; color: rgb(86, 86, 86); background: transparent;">It’s no secret where the Chamber is on this: we’re against it. And we’re not alone. I participated in a <a href="http://www.energyxxi.org/pages/Major_Economies_Business_Forum.aspx" target="blank" style="margin: 0px; padding: 0px; border: 0px; outline: 0px; vertical-align: baseline; color: rgb(0, 66, 118); text-decoration: none; font-weight: bold; background: transparent;">Major Economies Business Forum</a> meeting today, hosted by Danish Industry, with representatives from 14 large trade associations from most of the major economies, including China, India, and Brazil, and there was unanimity on the need to preserve IP rights. The group released a <a href="http://www.energyxxi.org/articles/Major_Economies_Business_Forum_Statement_from_Copenhagen.aspx" target="blank" style="margin: 0px; padding: 0px; border: 0px; outline: 0px; vertical-align: baseline; color: rgb(0, 66, 118); text-decoration: none; font-weight: bold; background: transparent;">statement</a> that read in part: “Weakening IPR protection would threaten the incentives businesses have to invest in creating and brining new technologies to market.”

 </h6><p style="margin: 0px 0px 1em; padding: 0px; border: 0px; outline: 0px; vertical-align: baseline; color: rgb(86, 86, 86); background: transparent;">I’ve been talking to a lot people about the stalemate here about the seemingly intractable issues that continue to divide developed and developing countries, and more and more, emerging and less developed countries, who don’t want to see the big guys crafting a deal behind closed doors.</p><p style="margin: 0px 0px 1em; padding: 0px; border: 0px; outline: 0px; vertical-align: baseline; color: rgb(86, 86, 86); background: transparent;">
<strong style="margin: 0px; padding: 0px; border: 0px; outline: 0px; vertical-align: baseline; background: transparent;">A very difficult reach</strong></p><p style="margin: 0px 0px 1em; padding: 0px; border: 0px; outline: 0px; vertical-align: baseline; color: rgb(86, 86, 86); background: transparent;">While few will admit to it publicly, I detect there’s a growing sense that the architecture of the Framework Convention itself makes a strong agreement that includes developing country participation very difficult reach. As one wag put it to me, if you set out to devise a treaty that would virtually guarantee paralysis, it would probably look a lot like the Framework Convention.

It’s a static document in a dynamic world, and it codifies a donor-donee mentality that reflected the view of the world as it was in 1992. As we know, the world has changed quite a bit since then. A new Minority Staff Report from the House Select Committee on Energy Security and Climate Change on the Copenhagen details just how much. For example, “59 Non-Annex I countries, including Brazil, South Africa, and China, have a GDP/capita larger than that of Ukraine, which has the smallest GDP/capita of any Annex I country.”

Obviously, developing countries have no incentive to move to a more dynamic approach—they have a sweet deal. Our position on trade provisions in climate change legislation that would set up trade barriers on imported goods from countries without “comparable” commitments has been clear and consistent—we don’t like them. And apparently we’re not alone.

The latest draft text under consideration in the Framework Convention’s “Long Term Cooperative Action” discussions has this bracketed and somewhat cryptic language in the section on the long-term vision. “[To be elaborated; provision on trade measures (reference to Art. 3, paragraph 5 of the Convention);]”

For those of you not steeped in the Convention, Article 3, paragraph 5 contains the following language: “Measures taken to combat climate change, including unilateral ones, should not constitute a means of arbitrary or unjustifiable discrimination or a disguised restriction on international trade.”

This new provision in the LCA draft is a direct response to the proposals by our own Congress for carbon tariffs. We’ve said all along that border adjustments would inevitably invite retaliation, and because no one wins a trade war, the threat of carbon tariffs has little value as a bargaining chip.
