The resolution is brought under the rules of the Congressional Review Act. It cannot be filibuster ed and needs only 51 votes to pass.  </span><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">Senate passage of S. J. Res. 26 will send a strong message to the White House and will put pressure on the House to vote on the resolution. It appears that the vote will be very close and could go either way. It’s critical that the Senators listed below hear from their constituents. Below the list of Senators are some talking points. </span><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">Thirty-eight Republicans and three Democrats have sponsored the resolution. Snowe, Collins, and Scott Brown (who was sworn in after the resolution was introduced) are not sponsors. Snowe is a likely No vote. The House passed Waxman-Markey 219-212, but many Members now wish they could have that vote back. </span><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">Support for cap-and-trade legislation has collapsed because the American people understand that it’s a huge energy tax on them. Global warming regularly ranks last in polls of voters’ concerns. </span><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">With cap-and-trade blocked at Congress’s front door, the Administration is trying the back door route to regulate greenhouse gas emissions using the Clean Air Act. </span><br style="font-family: " times="Times" new="New" roman="Roman" /><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">The Clean Air Act was designed to regulate air pollutants emitted in small quantities. It is ill-equipped to regulate a naturally-occurring trace gas necessary for life on Earth that is produced in huge quantities naturally and by burning coal, oil, and natural gas. As one Democratic Senator put it, the EPA is trying to “jam a square peg into a round hole.” </span><br style="font-family: " times="Times" new="New" roman="Roman" /><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">The EPA’s endangerment finding is not about science. It’s about regulatory over-reach. It will require massive regulations that will raise energy prices, destroy jobs, and cause economic havoc. </span><br style="font-family: " times="Times" new="New" roman="Roman" /><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">Under the endangerment finding, the EPA will use the Clean Air Act to regulate all vehicles in America in addition to six million “stationary sources”—power plants, factories, farms, office and apartment buildings, even hospitals and schools. Any new facility or changes in existing facilities will require cumbersome permits and expensive new equipment to minimize emissions. </span><br style="font-family: " times="Times" new="New" roman="Roman" /><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">The EPA has issued a “tailoring rule” to restrict the new regulations to large facilities. But that rule is illegal under the Clean Air Act and is likely to be overturned in court. Even if it survives a legal challenge, EPA intends to regulate smaller sources of emissions within a few years. </span><br style="font-family: " times="Times" new="New" roman="Roman" /><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">As Mississippi Governor Haley Barbour put it, “Reducing greenhouse gas emissions under the Clean Air Act will undoubtedly increase the cost of energy, increase the cost of doing business, increase the cost of consumer products, and jeopardize millions of jobs by putting U.S. manufacturers at a disadvantage against foreign competitors.” </span><br style="font-family: " times="Times" new="New" roman="Roman" /><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">Contrary to the apocalyptic commercials that environmental pressure groups are running, all that the resolution when enacted will do is prevent the EPA from issuing greenhouse gas regulations. It has nothing to do with overturning science or gutting the Clean Air Act. Nor does it prevent the Congress from working on climate legislation. </span><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb"> </span><br style="font-family: " times="Times" new="New" roman="Roman" /><span style="font-family: " times="Times" new="New" roman="Roman" background-color="background-color" rgb="rgb">The disapproval resolution needs a total of 51 votes to pass the Senate. Last year they changed the rule for organizing elections without approval by Congress.</span></p><p style="margin: 1em 0px; padding: 0px; border: 0px; line-height: normal;">Under the old rule, more than half of all workers needed to vote in favor of a union before it was formed. Now, all that is required is a majority of those voting. </p><p style="margin: 1em 0px; padding: 0px; border: 0px; line-height: normal;">Since the unions get to decide when a vote is held, it will now become possible for a small minority to decide to unionize by holding multiple votes with little notice and at inconvenient times. </p><p style="margin: 1em 0px; padding: 0px; border: 0px; line-height: normal;">Some Members of Congress are working to stop this power grab by Big Labor. The FAA Reauthorization Act of 2011 (H.R. 658) would restore the old rule—which had been the law for 75 years.</p><p style="margin: 1em 0px; padding: 0px; border: 0px; line-height: normal;">However, the Union Bosses are leaning on Congress to remove this provision from the bill. <font size="4" face="Times New Roman">"We can do better than <strong style=" box-sizing: border-box;">Joe Garcia</strong>," says a new television advertisement from Freedom Partners Action Fund, a super PAC that now has <a href="http://miamiherald.typepad.com/nakedpolitics/2014/09/another-conservative-super-pac-unveils-anti-joe-garcia-ad.html" target="_blank" style="box-sizing: border-box; text-decoration: none; background: transparent;">two spots</a> running against the Miami Democratic congressman.</font>

<font size="4" face="Times New Roman">The conservative group, which is funded by billionaire brothers <strong style=" box-sizing: border-box;">Charles</strong> and <strong style=" box-sizing: border-box;">David Koch </strong>and bills itself as a "free-market" organization, continues to hammer Garcia in the new ad over investigations into his past campaigns, making particular note of how the incumbent <a href="http://www.miamiherald.com/news/state/article1956389.html" target="blank" style="box-sizing: border-box; text-decoration: none; background: transparent;">paid</a> his former chief of staff a "campaign win bonus" even after the staffer was suspected of orchestrating an illegal absentee-ballot request scheme. He later <a href="http://www.miamiherald.com/news/local/community/miami-dade/article1956542.html" target="blank" style="box-sizing: border-box; text-decoration: none; background: transparent;">ended up</a> in jail.</font>

<font size="4" face="Times New Roman">The ad also criticizes Garcia for defending Obamacare "even with a double-digit premium increase" and for saying that "the economy is in a good place."</font>

<font size="4" face="Times New Roman">"Does that sound right to you?" the ad's narrator asks. She makes no mention of Garcia's Republican opponent, Miami-Dade County School Board member <strong style=" box-sizing: border-box;">Carlos Curbelo</strong>.</font>

<font size="4" face="Times New Roman">In a <a href="http://www.miamiherald.com/news/local/community/miami-dade/article2770433.html" target="_blank" style="box-sizing: border-box; text-decoration: none; background: transparent;">debate</a> Tuesday night, Garcia noted most of the ads against him have been funded by outside political groups and not from Curbelo himself, suggesting that, if elected, Curbelo would be subject to their interests.</font>

<font size="4" face="Times New Roman">Now, Charles and David Koch have formed a super PAC that can buy ads directly for specific candidates, but the organization also has to play by a new set of rules — when Freedom Action Partners Fund filed a quarterly report with the Federal Election Commission on Wednesday, it was also required to reveal its backers.</font>

<font size="4" face="Times New Roman"><span style=" margin: 0px; padding: 0px;"><a href="http://docquery.fec.gov/pdf/404/14978290404/14978290404.pdf" style=" margin: 0px; padding: 0px; border: 0px; text-decoration: none; background-color: transparent;">On the list of about 85 donors</a></span>, about half a dozen, besides the Kochs themselves who gave $2 million each,  had ties to the oil and gas industry. Among these donors, Robert Rowling, one of the richest people in the United States with a net worth of $5.4 billion, gave the most at $200,000. Rowling and his father owned Tana Oil and Gas before it was sold to Texaco in 1989 for $500 million; he now owns a hotel, resort and gym empire.</font>

<font size="4" face="Times New Roman">Other big givers were Edward Diefenthal, president and CEO of the Woodvine Group LLC, and Stephen Chazen, the president of Occidental Petroleum Corp. Dienfenthal gave $150,000 and Chazen gave $125,000.</font>

<font size="4" face="Times New Roman">Energy industry spending on the 2014 elections, $73 million, has only been half what it was in the 2012 elections, when the industry spent its highest amount ever in a single election cycle at $143 million,<span style=" margin: 0px; padding: 0px;"><a href="https://www.opensecrets.org/industries/indus.php?Ind=E" style=" margin: 0px; padding: 0px; border: 0px; text-decoration: none; background-color: transparent;">according to OpenSecrets</a></span>. There are still a few weeks left until polls close in early November, so the spending total could still eclipse previous cycles in 2008 and 2006, when $78 million and $83 million were spent.</font>

<font size="4" face="Times New Roman"><span style=" background-color: rgb(255, 255, 255);">But Texas energy political spenders have still been active this cycle.
