</font></div><div>...thousands of lawsuits around the nation claim glyphosate—the active ingredient in Monsanto’s popular weed killer Roundup—causes cancer. These cases are based on pretty much zero evidence, but if trial lawyers can get a jury to accept their false narrative, thousands of more cases may proceed.&nbsp;</div><div>The first case to reach trial involves DeWayne Johnson, a former school groundskeeper who applied Roundup to control weeds during his employment from 2012 to 2015. Johnson was diagnosed with non-Hodgkins lymphoma in August 2014, which his case claims is a “direct and proximate result” of his exposure to Roundup. No doubt, Johnson’s cancer is truly tragic, yet it’s highly unlikely to have anything to do with glyphosate.&nbsp;</div><div>
</div><div>Let’s look at the science. Numerous governmental bodies around the world have concluded glyphosate does not cause cancer in humans. For example, a 2016 evaluation by the World Health Organization’s Food and Agricultural Organization (FAO) notes: “[T]he only large cohort study of high quality found no evidence of an association at any exposure level.” In other words, the best quality research shows no evidence of cancer from glyphosate.&nbsp;</div><div>
</div><div>The only “evidence” supposedly comes from rodent studies. Yet the FAO study pointed out that rat studies found no association with cancer; only mice that were administered very high doses formed tumors. Such studies reveal little if anything about risks to humans exposed to very low amounts of the chemical. Indeed, many chemicals found in a healthy diet—including those that naturally form in fruits and vegetables such as carrots, celery, and lettuce—cause tumors in rodents when administered in massive doses. These tests remind us that it’s the dose that makes the poison.&nbsp;</div><div>
</div><div>Considering all this evidence, the FAO concluded that “glyphosate is unlikely to pose a carcinogenic risk to humans from exposure through the diet.” EPA’s 2017 draft risk assessment also concluded “glyphosate is not likely to be carcinogenic to humans,” which is the same conclusion drawn by the European Food Safety Authority in 2015.&nbsp; &nbsp;</div><div>
</div><div>The lawsuits proceed only because a single research body—the International Agency for Research on Cancer (IARC)—dubbed glyphosate a “probable carcinogen” in 2015. IARC classifications are developed by ad hoc working groups that are formed periodically to review science and classify chemicals based on cancer-causing potential. Working groups might label a chemical carcinogenic or place it within one of several lower-tier categories of “probably,” “possibly,” “not classifiable”, or “probably not” carcinogenic.&nbsp;</div><div>
</div><div>These IARC classifications are, by and large, meaningless because they only assess hazard, which is just the first step in risk assessment. A hazard assessment simply considers whether at some exposure level and under some circumstance a substance might pose a risk. The next steps consider at what doses and potency might a chemical pose risks and whether actual human exposures are significant enough to pose risks.&nbsp;</div><div>
</div><div>During congressional hearings in early 2018, Dr. Timothy Pastoor, CEO of Pastoor Science Communications, pointed out the absurdities of IARC’s incomplete approach. Exposure is crucial to understanding risk, he explained. For example, aspirin is a valuable pain reliever at low exposures but deadly at high ones. Because IARC fails to consider potency and exposure levels, the agency ranks plutonium and salty fish in same carcinogenic category, which is clearly absurd.&nbsp;</div><div>
</div><div>Indeed, many of IARC’s classifications are nonsensical. Consider the fact that the agency lists “smoking tobacco” in the same category with wood dust, painting houses for a living, and even eating bologna sandwiches. Yet you can’t even begin to compare the theoretical risks associated with eating bologna or working as a painter with actual smoking-related deaths that total nearly half a million annually in the United States alone.&nbsp;</div><div>
</div><div>IARC places glyphosate in a lower-risk category of “probably” carcinogenic. Among other probable carcinogens are a wide range of industrial chemicals as well as diseases such as Malaria and the human papillomavirus type 68, and more mundane things like red meat, being a hairdresser, or “shift working” that disrupts regular sleep hours. Coffee is fine, but don’t drink it too hot, because hot beverages are also “probably carcinogenic.”&nbsp;</div><div>
</div><div>IARC’s faulty process is compounded by the fact that its decisions appear tainted by anti-chemical ideologies and conflicts of interest. In the glyphosate case, IARC enlisted Environmental Defense Fund (EDF) activist Christiopher Portier to help as an “advisor” on the decision. EDF is an anti-chemical activist group, which should have no influence over what is supposed to be a purely scientific evaluation.&nbsp;</div><div>
</div><div>An exposé by blogger David Zauk revealed the fact that Portier also had a serious financial conflict of interest. Within a week of the IARC classification, attorneys that had been developing lawsuits against Monsanto retained Poitier as an expert witness. After signing with the law firm, Portier collected more than $160,000 for his services while trotting the globe lobbying for government bans on glyphosate, all without disclosing who compensated him.&nbsp;</div><div>
</div><div>If that were not bad enough, Reuters’ investigative reporter Kate Kelland discovered that the IARC monograph was essentially doctored at the last minute to change the final conclusion. Kelland reported: “Reuters found 10 significant changes that were made between the draft chapter on animal studies and the published version of IARC’s glyphosate assessment. In each case, a negative conclusion about glyphosate leading to tumors was either deleted or replaced with a neutral or positive one. Reuters was unable to determine who made the changes.”&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;</div><div>
</div><div>No court of law—or anyone else for that matter—should take any IARC decision seriously. Unfortunately, trial lawyers may be even more talented than IARC in peddling self-serving false narratives. Hopefully, Monsanto will fight this to the bitter end rather than settle because one settlement will lead to more, and eventually push a valuable product out of the marketplace for no good reason.&nbsp;</div><div>

Misleading Classifications Promote Counterproductive Bans and Adverse Market Impacts

</div><div style="background-color: rgb(255, 255, 255);">Numerous scientific bodies around the world, both public and private, attempt to assess the

cancer-causing potential of various industrial chemicals. Ideally, those research programs

should inform everyone, from policy makers to manufacturers to consumers, enabling

people to make better decisions to minimize risks. However, too often classification

programs rely on outdated and faulty methodologies and are influenced by political

considerations that lead to inappropriate cancer classifications. Their faulty conclusions can

create serious problems, including bans on useful products, market deselection of such

products, and public confusion about cancer risks<b>.&nbsp;</b></div><div style="background-color: rgb(255, 255, 255);"><b>Unfortunately, such problems are

becoming commonplace.

Among some of the most flawed programs is the Lyon, France-based International Agency

for Research on Cancer (IARC),</b> which is partly funded by U.S. government grants. IARC

classifications are highly influential and often generate headlines that can be alarming to

consumers and can trigger regulatory actions around the world. But as this paper details,

IARC’s process for designating chemicals as carcinogenic is flawed and increasingly

susceptible to political influences.

IARC’s misguided 2015 classification of the weed killer glyphosate as “probably

carcinogenic” exemplifies the far-reaching, adverse impacts associated with faulty

classifications. Although the overwhelming body of science indicates that glyphosate, which

is the active ingredient of Monsanto’s Roundup, is not a carcinogen, a California jury used

it as a basis for a $289 million award to a plaintiff who claimed it caused or contributed to

his non-Hodgkin’s lymphoma. About 8,000 other lawsuits are pending. Governments

around the world may follow up with bans, which may eventually force Monsanto to

abandon one of its most popular and beneficial products. Farmers will suffer as they lose

access to a useful tool while few alternatives exist. For consumers, it will mean higher food

prices.

IARC Mission and Funding. Launched in 1965, IARC is a division of the World

Health Organization, which is part of the United Nations. IARC’s mission, as described on

its website, is to “promote international collaboration in cancer research.” It focuses on

assessing environmental cancer risks, which includes any non-genetic cause of cancer.

IARC notes that its classifications are supposed to inform lawmakers and regulators,

promoting policies that will reduce cancer risks.</div><div style="background-color: rgb(255, 255, 255);">&nbsp;* Angela Logomasini is a senior fellow at the Competitive Enterprise Institute....</div><div style="background-color: rgb(255, 255, 255);"><font face="Times New Roman" size="4" style="">==</font></div><div style="background-color: rgb(255, 255, 255);"><font face="Times New Roman" size="4" style="">PERC</font></div><div style=""><div id="block-views-staff-block" class="block block-views first odd" style="margin-bottom: 1.5em; overflow: hidden;"><div class="view view-staff view-id-staff view-display-id-block view-dom-id-9f989735239905230d6ca07a1454e308" style=""><div class="view-content" style="background-color: rgb(255, 255, 255);"><div class="views-row views-row-1 views-row-odd views-row-first views-row-last" style="clear: left;"><div class="views-field views-field-title"><span class="field-content"><a href="https://www.perc.org/staff/angela-logomasini" style="text-transform: uppercase; font-weight: bold; text-decoration-line: none;"><font size="4" face="Times New Roman">ANGELA LOGOMASINI</font></a></span></div><div class="views-field views-field-body"><div class="field-content"><font size="4" face="Times New Roman"><span class="views-field views-field-view-node" style="margin-right: 20px;"><span class="field-content"><span class="views-field views-field-nothing" style="margin-right: 20px;"><span class="field-content"><a href="https://www.perc.org/articles/author/4171" style="">More Articles by Angela Logomasini ></a></span></span></span></span></font></div></div></div></div><div id="block-views-search-block-1" class="block block-views last even" style="margin-bottom: 1.5em;"><h2 class="block__title block-title" style="background-color: rgb(255, 255, 255); line-height: 1.71429em; margin: 0px;"><font size="4" face="Times New Roman">Related Content</font></h2><div class="view view-search view-id-search view-display-id-block_1 view-dom-id-43a5cb9f2f927a19bdb628c1ef7b5ec3" style=""><div class="view-content" style=""><div class="views-row views-row-1 views-row-odd views-row-first" style="background-color: rgb(255, 255, 255); margin-bottom: 0.5em;"><div class="views-field views-field-title"><span class="field-content"><a href="https://www.perc.org/articles/bush-administrations-environmental-policies-ii" style=""><font size="4" face="Times New Roman">Bush Administration's Environmental Policies II</font></a></span></div></div><div class="views-row views-row-2 views-row-even" style="background-color: rgb(255, 255, 255); margin-bottom: 0.5em;"><div class="views-field views-field-title"><span class="field-content"><a href="https://www.perc.org/articles/cautionary-tale" style=""><font size="4" face="Times New Roman">A Cautionary Tale</font></a></span></div></div><div class="views-row views-row-3 views-row-odd" style="background-color: rgb(255, 255, 255); margin-bottom: 0.5em;"><div class="views-field views-field-title"><span class="field-content"><a href="https://www.perc.org/articles/book-review-drinking-water-history-lone-mountain-fellow-james-salzman" style=""><font size="4" face="Times New Roman">Book review: ‘Drinking Water: A History’ by Lone Mountain Fellow James Salzman</font></a></span></div></div><div class="views-row views-row-4 views-row-even" style="background-color: rgb(255, 255, 255); margin-bottom: 0.5em;"><div class="views-field views-field-title"><span class="field-content"><a href="https://www.perc.org/articles/trees-rescue" style=""><font size="4" face="Times New Roman">Trees to the Rescue</font></a></span></div></div><div class="views-row views-row-5 views-row-odd views-row-last" style="margin-bottom: 0.5em;"><div class="views-field views-field-title" style="background-color: rgb(255, 255, 255);"><span class="field-content"><a href="https://www.perc.org/articles/grades-bushs-environmental-policies" style=""><font size="4" face="Times New Roman">Grades on Bush's Environmental Policies</font></a></span></div><div class="views-field views-field-title" style="background-color: rgb(255, 255, 255);"><font size="4" face="Times New Roman">

excessive burdens and allow communities

to allocate resources according to

their greatest needs. This approach makes

good sense, as each community certainly

The Bush administration has not endorsed

lead in its drinking water—levels that exceeded

federal standards by many times.

The issue raised concerns about lead’s potential

impact on children’s learning abilities.

Partly because Washington is the seat

of the national government, the discovery

led to active involvement by Congress and

the current administration.&nbsp;</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman">Background&nbsp;</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman" style="background-color: rgb(255, 255, 102);">Sensationalist coverage in media captured

the nation discovered they too had excess</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman"><span style="background-color: rgb(255, 255, 102);">lead in their drinking water</span>, although at

lower levels than found in Washington, D.C.

Members of Congress have held hearings

and are considering beefing up the

nation’s drinking water law. Legislation offered

by D.C. delegate Eleanor Holmes

Norton5 and a companion Senate bill offered

by Sen. James Jeffords (I-Vt.)6 would demand

that public water systems commence

programs to replace lead service lines—the

pipes that transport water under streets to

residential lines—replacing portions annually

until such lines are eliminated.&nbsp;</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman">The Administration’s Role&nbsp;</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><span style="font-family: " times="Times" new="New" roman="Roman" font-size="font-size" large="large"><font size="4" face="Times New Roman"><span style="background-color: rgb(255, 255, 102);">In contrast, administration officials argued

at these hearings that new federal

regulations for lead are premature

(Grumbles 2004</span>). The administration is

right to recognize that a panicked federal

response is neither necessary nor productive.

The science and the history related to

lead exposure strongly indicates that lead

in drinking water—even at levels that are

multiple times higher than federal standards—does

not pose serious risks and does

not warrant new regulatory measures.

A recently released Centers for Disease

Control and Prevention (CDC) study reinforces

these findings. It found that lead recently

discovered in District of Columbia

water did not raise the level of lead in an

exposed individual’s blood to a point of concern.

The study noted that the amount of

lead found in individuals’ blood today is

largely the result of other exposures—particularly

peeling lead paint a</font></span></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman">R&nbsp;</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman">The District government and the CDC

discovered that every child they found with

elevated lead levels in D.C. also lives in a

home with peeling lead paint and/or lead containing

dust from renovations. Daniel R.

Lucey, the District’s interim chief medical

officer, reported to the Washington Post that

based on tests of about 1,100 children, <span style="background-color: rgb(255, 255, 102);">14

children were found with elevated lead levels.

Six of these children didn’t even live in

homes with lead service lines. Moreover,

tests on about 200 people of all ages from

homes with the highest lead levels in the

water didn’t find anyone with blood containing

lead at levels of concern (Goldstein

2004). Lucey explained: “We are not seeing

any widespread lead toxicity attributable to

the water in D.C.”</span> (Goldstein 2004, B01).<b>

The District of Columbia appears to

have the worst case of elevated lead levels

so far discovered in the nation, yet there is

no evidence of a public health problem</b>. Accordingly,

the federal government could

mandate more lead line replacements

around the nation at an enormous cost and

still have little impact on lead blood levels.

For example, the cost to replace lead service

lines that exist in some D.C. neighborhoods

is estimated at $300 to $500 million,

plus an additional cost for upgrading lines

owned by homeowners estimated at $50 to

$60 million, according to the Association of

Metropolitan Water Agencies (Ware 2004).

If communities around the nation are forced

into such expenditures, they will have much

less money available to allocate to other

needs, such as upgrading schools and providing

essential services to the community—

which means that new, more stringent lead</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman">regulations will likely produce significant

welfare losses.&nbsp;</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman">Moreover, a federally mandated policy

promoting lead service line replacements

assumes that we have a simple solution: Replace

lines and lead problems will disappear.

But the reality is quite different. Because

many homes may still have lead lines inside,

replacement of service lines might still fail

to provide measurable benefits in many instances.

Lead contamination may come not

from service lines but directly from the tap

(American Water Works Association 1996).

In addition, mandated line replacement

means systems do not have any flexibility in

determining if better options exist.

The D.C. lead case illustrates why these

issues demand local solutions. The city is

investigating several potential causes of the

problem and potential solutions that don’t

warrant or require line replacement. In particular,

the problem might have been caused

by the switching of disinfection products

from chlorine gas to liquid chlorine—which

potentially caused more corrosion of pipes,

releasing additional lead. The District government

is investigating products it can use

to reverse the problem without removing the

lines. In addition, it is also possible that

D.C.’s recent replacement of water meters

has caused increased lead in the system. In

that case, lead line replacement would not

be likely to solve the problem.

Hence, the lead case shows that local

problems are often the result of situation specific

events. <b>The Bush administration is

correct that more national regulations are

not warranted, </b>but officials have not ruled

out federal action, indicating that if politi</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman">cal pressure gets too high, they might be

willing to cave on this position. Even so, the

administration receives a B+ for its handling

of the lead issue.

Lead Controversy B+

THE FINAL GRADE

As noted, the Bush administration’s poor

handling of drinking water issues yielded

only a D grade. The administration not only

imposed a misguided arsenic standard, it

failed to provide regulatory relief allowed

under the law for low-income communities,

even though Congress intended the agency

to use this relief under such circumstances.

In contrast, the administration earned a B+

for its more judicious handling of the lead

issue and for its recognition that a rush to

regulate would not constitute the best public

health policy. Accordingly, the final grade

for drinking water averages out to a C+.</font></p><p style="margin-top: 8px; margin-bottom: 8px;"><font size="4" face="Times New Roman"><span style="background-color: rgb(255, 255, 255);"></span>
