WHO IS NATIVE AMERICAN?
What makes a person a Native American? This is an important and controversial topic. Is a person a Native American because of his or her ancestry, culture, or political status, or because of self-identifications, which may or may not be verifiable? Who is entitled to live on tribal lands or share tribal revenue? Whose voice must be heard when consensus decisions are made either within Indian nations or between Indian nations and foreign governments? Who has the right to carry a Native American passport?
Criteria that establish Indian identity may include membership in or adoption by a recognized Indian family, a specific percentage of Indian ‘blood’ (blood quantum, in legal terms, endnote #5), or residence on tribal lands. Among some tribes, to claim tribal membership, you need only trace your genealogy to a Native American ancestor. (By this definition, former American President Bill Clinton is Cherokee.)
The United States government has frequently issued statutes that attempt to define Native ethnicity in order to clarify the rights of its “domestic dependent nations.” The results have been uniformly disastrous. For example, during the early nineteenth century (1800s), many Native people did not register on U.S. government-sponsored tribal rolls. They (the Native People) did not recognize United States jurisdiction or care about the government’s attempts to quantify them. TODAY, their descendants are clearly Native American, though not in the eyes of the U.S. government. Entire tribes, such as the forty-thousand-member (40,000) Lumbee of North Carolina and the Duwamish of Washington (tribe of the famous Chief Seattle), remain unrecognized and are defined by the United states as NONEXISTENT, often because of:
ignorance of a tribe’s history and continuity;
lack of distinct, treaty-guaranteed lands;
and greed {for title over contested tribal {homelands and their resources.
The Native American identity issue was highlighted in 1990 with the passage of the UNITED STATES INDIAN ARTS AND CRAFTS ACT. THE ACT MADE IT ILLEGAL FOR NON-INDIANS TO SELL GOODS THAT ARE LABELED ‘Indian-made.’
The law was designed to protect both consumers and Native Americans and has a clear application when you turn over an “Indian-made” pottery bowl and Discover that it was ‘made in Japan.” The law, however, also allows the U.S. government to prosecute Native Americans who do not meetUNITED STATES DEFINITIONS OF IDENTITY.
A descendant of a non-enrolled Native American or a member of a Native American community who does not have the requisite blood quantum can no longer legally sell “Indian-made jewelry at a pow-wow.
The real issue here is not WHAT determines Indian identity but WHO determines it.
The QUESTION of Indian identity should not be in the hands of United States courts in the first place but rather decided by Native American nations and communities.
Kanien’kehaka (Mohawk) scholar Taiaiake Alfred brings wisdom and clarity to the issue:
Respecting the right of (indigenous) communities to determine membership
for themselves would promote reconstruction of indigenous nations as groups
of related people, descended from historic tribal communities, who meet
commonly defined cultural racial characteristics for inclusion. (endnote #6)

Additionally, since the people who gang raped me included numerous uniformed police and sheriffs from several counties in the state of Wisconsin – DO NOT call them as a means to pass the buck/responsibility to assist me in any way. I have severe panic attacks caused by these gang rapes and I will not hesitate to file a civil rights lawsuit against anyone who send this type of authoritarian to continue to harass me. As of the date of this memo, I continue to be threatened by law enforcement, criminal family members, Meridian Group Inc staff, Kent Lovern, David Crowley, the residents of Pioneer Place Building One in Poynette, WI, and Michael Tsarion and his satanic cult and Mayor Nelson of the City of Franklin, WI, law enforcement of Columbia County, Wisconsin, law enforcement of the city of Franklin, Wisconsin, and law enforcement of Oak Creek, Wisconsin who have threatened my life and the lives of my service dogs. I have tangible evidence of the crimes committed against me and the perpetrators know this and the location of same. Yet my WHISTLEBLOWER status has yet to be honored. I am again requesting Whistleblower protection because the Columbia County and Milwaukee Count law enforcement is once again attempting to obtain the tangible evidence I have accumulated that supports my assertions that they have threatened my life. Keep in mind that no efforts have been made to investigate my stolen vehicle, my stolen possessions, which to my knowledge were last in the possession of Columbia County law enforcement (Pierce?).
There is a rumor that I have or will have access to millions of dollars via the QFS system. This is what many of the perpetrators are after, especially my criminal family members who have already confessed to wanting to kill my service dogs, and bury me alive in an unmarked grave. I have long ago notified my bank of the identity theft that surrounds me and about the attempts to steal my social security deposits. I have published my intention to build/create a non-profit/charitable organization called Love Barn which will assist childless women with pets who are survivors of domestic abuse. I would like to start it with female Veterans of the United States Armed Services. I have previously published a method to receive donations for Love Barn. Because the United States Postal Service has stopped sending my mail and possibly the mail of other entities, I AM putting hold on my requests for donations and formally requesting an investigation of potential missing donation funds and the current practices of banking AND the Post Office. If anyone donated to Love Barn c/o Rosann Kohnke, M.A., they deserve to know what happened to their donation.
