While the Court was deciding the motions for summary judgment, the United States was notified pursuant to 28 U.S.C. § 2403(a) of the constitutional challenge to Section 11(b). Doc. No. [182]. The United States exercised its right to intervene in the case (Doc. No. [187]) and participated in a limited manner at the bench trial to ensure its defense of the statute.
