A Report and Recommendation

The magistrate judge reads through your complaint, the motion to dismiss or whatever motions were filed. Then give a report and recommendation on whether the motion should be granted or denied.

From there, if you are one of the parties to the action and you object to that report, you have 14 days to file an objection to that report, and if you don’t, the court can just go ahead and grant it. You can’t appeal that, because you didn’t object.

They are mixing constitutionally sound court principles with administrative principles and make it sound like its all on the up-and-up.
