Mr. Bookbinder quotes the Mises Institute in support of the benefits to the public of having a trial on the causes of climate change:

There are several problems with a trial, however.

As I said in the last post, plaintiffs in these climate-change suits don’t want a real trial. They either want a negotiated settlement or something that really isn’t a trial. As Ed Whelan highlighted in his article about the Supreme Court’s denial of the federal government’s motion for a stay, what they are asking for in Juliana v. United States isn’t really a trial at all.

In Juliana v. United States, the “trial” the plaintiffs seek looks like a cross between an international human rights court and an administrative-agency procedure. It represents a radical departure for the business of an Article III court. As Ed Whelan wrote,

The Government notes [not “argues”] that the suit is based on an assortment of unprecedented legal theories, such as a substantive due process right to certain climate conditions, and an equal protection right to live in the same climate as enjoyed by prior generations. The Government further points out that plaintiffs ask the District Court to create a “national remedial plan” to stabilize the climate and “restore the Earth’s energy balance.” (emphasis added).

Ed also observes: “At first blush, this might seem like a significant loss for the federal government. But the text of the Court’s order strongly suggests otherwise.”

As to Mr. Bookbinder’s reference to the Mises Institute quote regarding the benefit of a public trial, the economist who made the statement may not have understood that in order to file litigation, a legal complaint must ask for some remedy, such as damages from the defendant, in order to have “case or controversy.”

Although the plaintiffs do not actually want to go to trial, they are seeking damages. The defendants also do not want to go to trial. In the City of Oakland case, the companies have won on the law at the district court level, but that could be reversed on appeal. If the companies do not ultimately win on the law, they will settle in order to minimize damages.

The only real way to have a trial of climate-change science in the public arena is to decouple the damages claim and “try” the main issue: the causes of climate change. To do that, two ways come to mind.

In a state court having televised trials, a scientist who is a “climate-change denier” could sue for only nominal damages and an apology/retraction from those scientists who have publicly defamed his/her competence. Whereas the defendant might pay the nominal damages in order to end the litigation without the plaintiff’s agreement, he or she would be unlikely to confess error by making an apology/retraction. That could set up a real trial, pitting scientists with opposing views of climate change.

According to the controversial site OneNewsNow.com, Canseco argued that the rhetoric was wrong, stating, "It is really counterproductive to have a debate about whether or not there's climate change... What we should be having is a debate about policies that are promoted and implemented in the name of climate change and that negatively impact opportunities for our citizens and kill jobs."
Rep. Walsh has received an overall score of just 3% on LCV’s scorecard. In a Chicago Sun-Times questionnaire, Walsh said that although it's important to protect the environment, on climate change "The science is not clear yet.
State Children's Health Insurance Program (SCHIP)

In 2007, Congress took up the reauthorization of the State Children's Health Insurance Program, which provides health care for about 6 million children and 670,000 adults from families who earn too much money qualify for Medicare but not enough to afford health insurance. Congressional Democrats and many Republicans tried to use the opportunity to dramatically expand the program but were opposed by President George W. Bush and other Republicans. In 2006, 5.4 million children were eligible but not enrolled in SCHIP or Medicaid and 9.4 million total children were uninsured.
Representative Dan Lungren voted against the first House bill, which passed along party lines. It would have added $47 billion over five years to the $25 billion cost of the program and added about 5 million people to the program, including children, some legal immigrants, pregnant women and adults aged 18 and 19. The bill was financed mainly by an increase in cigarette taxes.

House Democrats, with 45 Republicans, later compromised and passed a bill which expanded the plan by $35 billion and would have insured about 3.5 million more children from families generally making between 250% and 300% of the federal poverty line (about $51,000 to $62,000 for a family of four). Most non-pregnant, childless adults were excluded, as were most legal immigrants and all illegal immigrants. Lungren voted against the bill.
After President Bush vetoed the bill, Democratic leaders attempted to override the veto with the same bill but failed. Lungren voted against the bill.
House Democrats then attempted to override it with another bill, which gave into Republican demands for increased checks for citizenship, the quick phasing-out of adult coverage, a hard limit of 300% of the federal poverty level and funding for families that covered their children through private insurance instead. Republicans, angry that the vote was scheduled during massive fires in California, blocked the veto override. Lungren voted against the bill.
Lungren was born September 22, 1946 in Long Beach, California. He earned a B.A. from the University of Notre Dame in 1968. After graduating, he returned to California to chair "Youth for Nixon." He began law school at the University of Southern California but transferred to Georgetown University Law Center where he earned his Juris Doctor in 1971.
From 1979-1989, Lungren served in the U.S. House representing California's 34th Congressional District. He left when California Governor George Deukmejian appointed him acting state Treasurer, but was Lungren was never confirmed.[1]. In 1990 he was elected California attorney general and served from 1991-1999. In 1998, Lungren ran as the Republican candidate for Governor of California, but was defeated by Lieutenant Governor Gray Davis.
Lungren said his desire to serve in Congress was rekindled by the September 11, 2001 attacks. Lungren re-entered the House in 2005.
