Naffe claims she posed as O'Keefe's companion, enabling him to gain access to the bank where Waters' husband works. According to Naffe, James O'Keefe sent her an email describing a loophole that 'gave citizen journalists the same wiretapping authority as law enforcement and the FBI.'

Naffe also now says 'James received a shipment of high-tech recording devices during the trip. His intent was to wiretap the bank.'

Reporting to Breitbart, O'Keefe toured OneUnited bank locations trying to prove they had benefited from TARP bailouts which Rep. Waters supported, according to the post. Naffe also promises further installments that will describe her experience in O'Keefe's "barn" and theaftermath which led her to contact police.

Naffe does not state whether she or O'Keefe actually placed listening devices in the target sites, but she certainly leads her readers to such an implication. Much of Naffe's post is left vague, but if true, it does bring up controversial questions about O'Keefe's assumption he could plant bugs targeting elected officials or their contacts just because he suspects fraud or bribery has taken place.

O'Keefe is said to have told Naffe that California wiretapping statutes didn't apply when collecting "bribery evidence" from banks:
Naffe says she came clean about her part in the plot, also apologizing to OneUnited CEO Kevin Cohee.

Says Naffe, "The only thing that kept James and Breitbart from driving a stake through Waters heart was the backlash from a selectively edited video of former USDA employee Shirley Sherrod". This sounds like anything O'Keefe and Breitbart might have found to discredit Waters could have been buried because of the way the information may have been obtained. Many questions remain.

Last Friday's report on the hypocrisy of Andrew Breitbart's selective concern for alleged rape victims in "Does Breitbart's Rape Rant Apply to James O'Keefe's Alleged "Barn" Incident??" brought up a variety of rape-related issues that showed Breitbart seemed to be selectively exploiting the issue. Also Friday, Current TV put the claims of Nadia Naffe on the TV for the first time.

Breitbart stated plainly he'd screamed "stop raping people" to OWS demonstrators as a "stunt" to get attention focused on the underreporting of a handful of alleged rapes at OWS. After accusing people in mass quantities of being rapists, we thought it odd that Breitbart wasn't addressing criminal harrassment allegations made against his star reporter James O'Keefe.

Last December, a Breitbart columnist named Nadia Naffe filed a complaint alleging O'Keefe became verbally abusive after drinks, trying to coerce her to spend the night in his "barn" - as she realized she was losing muscle control.

The story aired on Countdown with Keith Olbermann, with fill-in host David Shuster unloading on Breitbart as a "hypocrite" and "frequently unstable publicity seeking hack" who he said refused to comment on the issue when contacted. Shuster found this appropriate, because he said Breitbart didn't witness anything between and Naffe and O'Keefe and wasn't involved - but Naffe has shared new details claiming Breitbart knew, even as events were unfolding that night that Naffe wanted his help.

Breitbart finally spoke out - after Shuster tweeted the link to his segment on Breitbart. Shuster said:
"This alleged rape plot by @jamesokeefeiii + silence by @andrewbreitbart proves AB is a hypocrite."

Seething, Breitbart twote back:
"There is no 'rape plot' you slanderous, libelous wannabe Media Matters smear junkie".

This prompted Nadia Naffe to break her silence, tweeting to Breitbart:
"Now, your an expert on 'rape plots'? I called you that night I was held in the barn to ask for help."

This is apparently the first time anywhere the public has heard her characterize her ordeal at O'Keefe's parents property as being "held". If true, it also reveals that Naffe reached out to Breitbart for help when she was experiencing problems with O'Keefe.

Naffe's complaint described O'Keefe becoming argumentative as she expressed a desire to leave O'Keefe's parents' premises before, but the word "held" could be construed differently, for example if her movements or freedom were restricted.

Sounding testy, this writer believes Breitbart's out-of-hand dismissal of the idea that there was no "alleged rape plot" annoyed Naffe. This seems to support the point in the article - that Breitbart's publicity-seeking and concern for alleged victim's rights didn't seem to extend to Naffe, while he caterwauled like a maniac in publicizing the plight of those allegedly accosted at OWS.

Naffe had been retweeting Breitbart's tweets as recently as Feb. 14, suggesting she must have been at least lukewarm towards Breitbart. But this tweet by Naffe to Breitbart doesn't appear to convey he was much help to her the night she alleges she lost her ability to walk. It appears Naffe and Breitbart see the incident differently, with Naffe questioning Breitbart on what does and doesn't constitute an 'alleged rape plot'.

Adding to the contention have been threats of legal action made by O'Keefe, also via public tweets, because Shuster referred to him as a "convicted felon" instead of "convicted criminal" - O'Keefe's guilty plea was on a misdemeanor charge. O'Keefe claims this was no accident, because Countdown had made the same "lie" before. A commenter on the Current TV web page for the segment corrected the error within hours.

Naffe's latest tweets suggest she is fired up about the hypocrisy and bullying and is planning to speak out about O'Keefe's alleged harassment and "recordings" she'd helped O'Keefe make in past "agitprop" undertakings.

Naffe on the legal threats:
O'keefe's threat to sue @DavidShuster into silence is just like the one he used to bully me not to report crime to police.

Then, in reply to this tweet by Shuster:
Hey @JamesokeefeIII apologize to @nadianaffe. And @AndrewBreitbart why wont u condemn his alleged sex assault plan?

Naffe twote:
I'm not looking for an apology. I've been the one apologizing, to people I recorded w/O'keefe since 2010.

and added:
Would not expect public condemnation of O'keefe by @AndrewBreitbart. Admitting your wrong isn't good for business.

Later, Naffe twote:
I still dont know the identity of the man O'keefe brought with him to the barn that night, to intimidate or worse, assault me

and finally, she seems now ready to go public with her version of the incident and talk about her involvement going back to 2010 in making "recordings" of people Naffe feels a need to apologize to:
Working on a post abt what happened at the barn in NJ, and my work as an accomplice to a "convicted criminal" O'keefe et al

Nadia Naffe sued Deputy District Attorney John Patrick Frey who has purportedly known (nonparty) O'Keefe since the muckraker worked as an intern in the Los Angeles County District Attorney's Office as a law school student.

Naffe, a reported Harvard graduate, says she too was a friend and colleague of O'Keefe's until "a frightening incident" in October 2011 when O'Keefe allegedly drugged her in an attempt to sexually assault her in a renovated New Jersey barn.
At that time, O'Keefe was on three years probation for entering federal property during an undercover sting on U.S. Senator Mary Landrieu, D-La., the complaint says.
blog: s another episode of “As the Right Wing Turns”, gentle readers. This episode features Patterico aka John Patrick Frey, who is about to face Nadia Naffe in court on Thursday over her lawsuit concerning Frey’s conduct with regard to her personal information.

Frey, who claims he doesn’t act in any “official capacity” when he blogs, forgets that claim when it comes to being the attack dog to protect Islamophobes who outright call for the death of all Muslims. Patterico whines:

After I wrote about Kimberlin’s past in October 2010, Kimberlin and his supporters launched a harassment campaign against me and other critics of Kimberlin’s, including: harassment of wives and family members; publication of home addresses and pictures of people’s homes; frivolous workplace complaints; the filing or threatening of frivolous lawsuits; frivolous applications for restraining orders; outing people’s identities; whisper campaigns; frivolous claims and reports to law enforcement of criminal wrongdoing; frivolous State Bar complaints or threats to file State Bar complaints; publication of a photo of a nude man that was falsely claimed to be a photo of the victim; defamation; daily abusive name-calling; and other harassment.

Awful, awful harassment indeed. But enough about you. Let’s talk about your conduct. Particularly your online conduct. There’s a pattern there, one we believe investigators in the District Attorney’s office should know about.

On April 18th, John Patrick Frey will have to appear before a judge and defend his indefensible abuse of power with regard to how he bullied Nadia Naffe. Please read the paragraph we quoted above once again. It’s quite official-sounding, isn’t it? Almost sounds like a prosecutor’s argument. According to Naffe’s complaint, Frey demonstrates a pattern of conduct of using his official position to intimidate others and elevate himself because of his official standing. One might even see that in tonight’s post, where he offers his “services” to Erik Rush. We quote:

First, the defendant’s action must have been performed while the officer is acting, purporting, or pretending to act in the performance of his or her official duties. FAC ¶ 10. In fact, Frey explicitly acknowledged that “Patterico’s Pontifications” was linked to his position as a Deputy District Attorney. Id. ¶10(n). In a September 9, 2009 blog post entitled “Patterico Banned at the L.A. (emphasis added). Frey’s own words indicate that Patterico is an expressive outlet for Frey’s official work as a Deputy District Attorney and shows that Frey perceived any purported ban on Patterico to also be an attack on Frey’s position as Deputy District Attorney. And based on Frey’s repeated reference to his position as a prosecutor, this is precisely how other media outlets viewed “Patterico’s Pontifications.” Id. ¶15. Additionally, Frey repeatedly invoked his position as a prosecutor to lend substance and weight to his opinions.

Patterico has a long running history and visible web presence as the work product of a Deputy District Attorney. Frey simultaneously disclaims his position as a Deputy District Attorney to avoid liability and invokes it to seek credibility and issue threats of criminal investigation. Against this backdrop, Defendant Frey issued statements to Ms. Naffe, which a reasonable person could infer were threats to investigate and prosecute or to influence others prosecutors (including federal prosecutors) to do so. Frey only uttered such threats to Ms. Naffe after she informed Frey that she would report him to the District Attorney’s Office and the State Bar.

Because Frey’s online persona, found through “Patterico’s Pontifications” and on Twitter with @patterico, was a digital extension of his real life role as Deputy District Attorney, Frey acted under color of state law when he threatened to investigate Ms. Naffe for criminal misconduct and then retaliated against when he published her Social Security number and other private data on his blog.

And once again, that same pattern of conduct exists with respect to his “offer” to Erik Rush to speak to investigators “any time” about people who have absolutely no connection to recent events in Boston or near Rush’s residence. Despite Frey’s protestations in his response to Naffe’s complaint about how prosecutors do not conduct their business online, it is unrealistic to believe that his position as prosecutor has no bearing on his influence on others when interacting online. Would a district court judge be permitted to opine online in such a way, while informing observers that he was, in fact, a district court judge? No. That would violate the code of judicial conduct. Frey’s position as Deputy District Attorney is one he touts as a way to wield wider and deeper influence and trust with those who interact with him.

We at BreitbartUnmasked wonder why, in his hysteria over the SWATting that wasn’t anything of the kind, Mr. Frey neglected to mention the closure of the Carroll County Courthouse on the very day nuisance complaints against Neal Rauhauser, Brett Kimberlin and Bill Schmalfeldt were to be dismissed. Why isn’t he calling the tip line and sharing all of his information with them? It was, after all, a bomb threat. This particular bomb threat, however, didn’t fit Frey’s case before his audience. Why would Brett Kimberlin shut down a courthouse when he was about to have cases dismissed in that very courthouse? Of course he wouldn’t. It’s not in his self-interest, nor is it John Patrick Frey’s interest to mention the coincidental timing of a very serious incident.

We simply find it fascinating that John Patrick Frey is quick to invoke Brett Kimberlin’s name when he can associate him with a smear and a bomb, but not quite so fast to mention situations that contradict his prosecutorial arguments against Kimberlin, et al.

We wish Nadia Naffe luck on Thursday as she stands up to the bully who robbed her of over one year of her life in order to protect a lying weasel who actually should be prosecuted instead of held up as some kind of hero.
