Legislation

“What, then, is legislation? It is an assumption by one man, or body of men, of absolute, irresponsible dominion over all other men whom they call subject to their power. It is the assumption by one man, or body of men, of a right to subject all other men to their will and their service. It is the assumption by one man, or body of men, of a right to abolish outright all the natural rights, all the natural liberty of all other men; to make all other men their slaves; to arbitrarily dictate to all other men what they may, and may not, do; what they may, and may not, have; what they may, and may not, be. It is, in short, the assumption of a right to banish the principle of human rights, the principle of justice itself, from off the earth, and set up their own personal will, pleasure, and interest in its place. All this, and nothing less, is involved in the very idea that there can
be any such thing as human [CIVIL] legislation that is obligatory upon those upon
whom it is imposed.”
Natural Law, Chapter 1, Section IV, [Lysander Spooner]
Liberty means basically the lack of legislation. It does not mean freedom. Freedom is protected when liberty prevails.
A challenge: when your legislature is in session, see if there is any proposed legislation that is NOT written by a lawyer.
From the Articles of the Confederation:
- The Articles of Confederation only stated that the ratification of it contracted the states to bind themselves to the determination of the United States in Congress Assembled. This clause of this constitution declares that the lawful legislation emanating from this Congress would be Law of the Land.
- Each state ratified that each state would only allow officers, whether legislative or judicial, to take their positions if they swore to uphold the lawful legislation of the United States in Congress Assembled upon their own citizens.
If the people of these United States of America had, from the very beginning, understood true representative government; they would not have allowed their Congress to pass the 13th Amendment as it is worded. They should have never let the congress of the United States to have the power to enter their individual sovereign states with legislation to enforce for any purpose. Once that cat was let loose there was no stopping it on its road to complete domination of the states.
From the United States Constitution:
- “and the laws of the United States”, refers to the legislation produced by the United States. To properly recognize this phrase, the individual must first understand that the United States is not a country. The Articles of Confederation consistently refers to the United States as “the United States in Congress assembled”. The United States in this clause is not referring to the States and their own laws or their own constitutions; it is only referring to the laws legislated by the Congress of the United States when they are assembled for the purpose of legislation.
- “which shall be made in pursuance thereof” refers to the legislation produced by the United States in Congress assembled while pursuing the performance of the tasks which were assigned to the Congress in Article I, Section 8 of the constitution for the United States of America.
- “and the judges in every state shall be bound thereby” means that the judges of the states must uphold any legislation of the Congress of the United States providing that the legislation is within the narrow boundaries of the United States in Congress Assembled as set within the confines of this constitution.
