As noted in a <a href="http://www.nytimes.com/2014/10/31/us/politics/pr-executives-western-energy-alliance-speech-taped.html" target="blank" style=" border: 0px; margin: 0px; padding: 0px; color: rgb(102, 102, 102); text-decoration: none;">new story</a> by Eric Lipton at <em style=" border: 0px; margin: 0px; padding: 0px;">The New York Times</em>, Berman met with energy company executives at the posh Broadmoor Hotel earlier this year to raise money from them to attack groups representing citizens concerned about clean water, clean air, and the future of the planet. But Berman's "win ugly" tactics apparently did not persuade all of his prospective clients for his lucrative business of creating tax-exempt non-profit front groups that then contract with his for-profit PR firm to give corporations cover for his attacks on their opponents. The way Berman profits from this arrangement has spawned a <a href="http://www.prwatch.org/news/2012/11/11886/web-berman-front-groups-subject-irs-complaint" target="blank" style=" border: 0px; margin: 0px; padding: 0px; color: rgb(102, 102, 102); text-decoration: none;">legal complaint</a> to the IRS.
An audio tape of Berman and his associate, Jack Hubbard, has been provided by a person at the Broadmoor event to the Center for Media and Democracy, which publishes PRWatch and has long tracked Berman's <a href="http://www.sourcewatch.org/index.php/Rick_Berman" target="_blank" style=" border: 0px; margin: 0px; padding: 0px; color: rgb(102, 102, 102); text-decoration: none;">deceptive PR operations</a>.

<p style=" border: 0px; margin: 1em 0px; padding: 0px; background-color: rgb(238, 238, 238);">Meanwhile, Berman and Co. attack public interest groups for their donors and try to label opponents as "hypocrites" whenever possible even as he goes to great lengths to hide the money trail between him and some of the dirtiest industries on the planet.
The tape reveals more about Berman's targets beyond Greenpeace, Sierra Club, and unions, such as Food and Water Watch, the Park Foundation, the Humane Society, and Rep. Jared Polis. But they are in good company as Berman's targets alongside activist leaders like Robert Redford, Randi Weingarten who leads the American Federation of Teachers, and Tom Steyer, who is publicly known for funding efforts to protect the environment. Other Berman celebrity targets include Lady Gaga and Yoko Ono. (CMD--which launched ALECexposed.org and publishes PRWatch.org, SourceWatch.org, KochExposed.org, OutsourcingAmericaExposed.org, NFIBexposed.org, and other investigative sites--is also one of the groups targeted by Berman and his buddies in recent months.)
Undoubtedly, there will be more to come on Berman's tactics and operations.</p>

INGTON — If the oil and gas industry wants to prevent its opponents from slowing its efforts to drill in more places, it must be prepared to employ tactics like digging up embarrassing tidbits about environmentalists and liberal celebrities, a veteran Washington political consultant told a room full of industry executives in a speech that was secretly recorded.
The blunt advice from the consultant, Richard Berman, the founder and chief executive of the Washington-based Berman & Company consulting firm, came as Mr. Berman solicited up to $3 million from oil and gas industry executives to finance an advertising and public relations campaign called Big Green Radicals.
The company executives, Mr. Berman said in his speech, must be willing to exploit emotions like fear, greed and anger and turn them against the environmental groups. And major corporations secretly financing such a campaign should not worry about offending the general public because “you can either win ugly or lose pretty,” he said.
<span style=" background-color: rgb(255, 255, 255);">Think of this as an endless war,” Mr. Berman <a title="A transcript of the talk." href="https://s3.amazonaws.com/s3.documentcloud.org/documents/1349204/berman-at-western-energy-alliance-june-2014-doc.pdf" style=" color: rgb(50, 104, 145);">told the crowd</a> at the June event in Colorado Springs, sponsored by the </span><span style=" background-color: rgb(255, 255, 102);">Western Energy Alliance, a group whose members include Devon Energy, Halliburton and Anadarko Petroleum, </span><span style=" background-color: rgb(255, 255, 255);">which specialize in extracting oil and gas through hydraulic fracturing, also known as fracking. “And you have to budget for it.”</span>
What Mr. Berman did not know — and what could now complicate his task of marginalizing environmental groups that want to impose limits on fracking — is that one of the energy industry executives recorded his remarks and was offended by them.
“That you have to play dirty to win,” said the executive, who provided a copy of the recording and the meeting agenda to The New York Times under the condition that his identity not be revealed. “It just left a bad taste in my mouth.”
Mr. Berman had flown to Colorado with Jack Hubbard, a vice president at Berman & Company, to discuss their newest public relations campaign, Big Green Radicals, which has already placed a series of intentionally controversial <a href="http://www.biggreenradicals.com/ads-media/" style=" color: rgb(50, 104, 145);">advertisements </a>in Pennsylvania and Colorado, two states where the debate over fracking has been intense. It has also paid to place the media campaign on websites serving national and Washington audiences.
A spokeswoman for Mr. Berman confirmed that he gave the speech, but said he would have no comment on its contents.
Mr. Berman is well known in Washington for his technique of creating nonprofit groups like the Center for Consumer Freedom that secretly collect corporate donations to finance the aggressive, often satirical media campaigns his team conceives. They are intended to undermine his opponents, like labor unions or animal rights groups that have tried to spotlight the treatment of animals at meatpacking plants.
“I get up every morning and I try to figure out how to screw with the labor unions — that’s my offense,” Mr. Berman said in his speech to the Western Energy Alliance. “I am just trying to figure out how I am going to reduce their brand.”</p>

Mr. Berman repeatedly boasted about how he could take checks from the oil and gas industry executives — he said he had already collected six-figure contributions from some of the executives in the room — and then hide their role in funding his campaigns.
“People always ask me one question all the time: ‘How do I know that I won’t be found out as a supporter of what you’re doing?’ ” Mr. Berman told the crowd. “We run all of this stuff through nonprofit organizations that are insulated from having to disclose donors. There is total anonymity. People don’t know who supports us.”
What is unclear is if the hardball tactics that Mr. Berman has pitched will succeed in places like Colorado. Already, The Denver Post editorial page, generally supportive of the oil and gas industry, <a href="http://www.denverpost.com/editorials/ci_26217999/flat-earth-ad-is-cheap-shot-at-fracking" style=" color: rgb(50, 104, 145);">has criticized</a> Mr. Berman’s tactics, calling one video spot — featuring fictitious environmentalists who debate if the moon is made of cheese before calling for a ban on fracking — “a cheap shot at fracking foes.”
In fact, at least one of the major oil and gas companies that had executives at the event — Anadarko, a Texas-based company that operates 13,000 wells in the Rocky Mountain region — now says that it did not agree with the suggestions that Mr. Berman offered on how to combat criticism of oil and gas drilling techniques.
“Anadarko did not support Mr. Berman’s approach and did not to participate in his work because it does not align with our values,” John Christiansen, a company spokesman, said.
Mr. Berman probably appreciates the criticism. As he explained in his remarks, what matters is increasing the number of people who see his work, which is part of the reason he intentionally tries to offend people in his media campaigns.
“They characterize us in a campaign as being the guys with the black helicopters,” he explained. “And to some degree, that’s true. We’re doing stuff to diminish the other sides’ ability to operate.”

I am one of the activists targeted by Berman. If you go to the website Berman highlighted in his speech, <a href="http://www.biggreenradicals.com/" target="_blank" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">BigGreenRadicals.org</a>, then click on “Colorado,” then click on “<a href="http://www.biggreenradicals.com/?post_type=activist&p=384" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">Gary Wockner</a>,” you’ll see Berman’s hit job (it’s not very accurate or insightful). I’m in good company there, joined by my Congressman Jared Polis, Yoko Ono, <a href="http://ecowatch.com/author/mruffalo/" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">Mark Ruffalo</a> and other local Colorado activists with whom I’ve been proud to work over the past couple of years.
A few environmental leaders are taking Berman and industry to task for their tactics targeting me and others. After reading the story in the <em style=" box-sizing: border-box; margin: 0px; padding: 0px;">Times</em>, Sierra Club Executive Director <a href="http://ecowatch.com/author/mbrune/" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">Michael Brune</a> said, “You know <a href="http://ecowatch.com/search/?q=climate+deniers" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">climate deniers</a> and big polluters are desperate when they turn to the tired old tactics of the tobacco industry to try and save themselves.” <a href="http://ecowatch.com/author/bkennedy/" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">Robert F. Kennedy, Jr.</a>called Berman “The Oil Reich’s Minister of Propaganda” in this tweet:
By the time the BigGreenRadicals.org website appeared in 2014, these personal attacks were old news in Colorado. The industry had been ramping up the negative rhetoric for over a year using <a href="http://thecoloradoobserver.com/2013/10/big-money-and-radical-activists-lurk-behind-fracking-bans-across-front-range/" target="_blank" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">Berman’s surrogate organizations</a>, especially before and after the industry lost the four local ballot initiatives in Fort Collins, Broomfield, Lafayette, and Boulder in <a href="http://ecowatch.com/2013/11/06/huge-election-victories-colorados-anti-fracking-movement/" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">November of 2013</a>which banned or put a long-term moratorium on fracking. At one point during the election, they made door-hangers with that hit-job against me (including my photo) and hung them on thousands of doors in Broomfield (it didn’t work; we won the election anyway).
The <a href="http://ecowatch.com/2014/06/25/oil-gas-industry-buys-colorado-fracking-election/" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">fracking wars in Colorado</a> are intense. I’ve chosen to be a <a href="http://garywockner.com/" target="_blank" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">visible public face, campaign organizer and spokesperson</a> fighting against fracking. I chose to do this because <a href="http://ecowatch.com/climate-change-news/" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">climate change</a>is real and is made worse by fracking for oil and gas, and because fracking causes severe negative impacts to public health, wildlife and landscapes, air and water, and to Colorado citizens’ property values. Further, I believe we need to switch to a <a href="http://ecowatch.com/business/renewables/" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">renewable energy</a>, no-carbon economy as soon as possible to mitigate and avert the worst impacts of climate change.
Mr. Berman has been doing negative personal attacks for a long time—in 2007, CBS’s 60 minutes described him as “<a href="http://fuelfix.com/blog/2014/10/30/fracking-advocates-urged-to-win-ugly-by-discrediting-foes/" target="_blank" style=" box-sizing: border-box; margin: 0px; padding: 0px; text-decoration: none; color: rgb(67, 146, 65); transition: color 0.2s linear; -webkit-transition: color 0.2s linear; background: transparent;">Dr. Evil</a>” for his past work attacking unions and animal rights groups. Now, the oil and gas industry has hired him to attack environmental activists in Colorado, thus solidifying the industry’s role here as a propaganda machine that will pretty much say and do anything to anyone to maximize their short-term profit at the complete expense of the public’s and environment’s long-term health. Perhaps this is a fight of good vs. evil, and so perhaps they’ve hired the right man.
Why are they attacking environmental activists? Because we are making a difference.

Secret Tape Exposes Fracking Industry Playing Dirty</p>
<p>

<p>
Right-wing public relations consultant/astroturf king Richard Berman probably wasn’t very happy when he saw yesterday’s New York Times. Like the now infamous American Legislative Exchange Council (ALEC), Berman’s success depends in large part on anonymity. He is known for his use of what’s called “astroturf” groups—organizations that appear to be community or citizen advocacy groups with names like “Center for Consumer Freedom” but are really shell groups for untraceable corporate donations—to attack labor unions, environmental laws, attempts to regulate the food industry and anti-smoking measures. Lately, he’s been a conduit for fossil fuel interests with his Big Green Radicals campaign, based on the mockery and personal destruction of those who advocate for the environment.</p>
<p>
At the secretly taped presentation, Richard Berman and Jack Hubbard laid out their strategy of playing dirty, saying “You can win ugly or lose pretty.” Photo credit: Oil Change International
But one industry executive had enough. The anonymous executive leaked a tape to the New York Times of a June event in Colorado Springs at which Berman and Jack Hubbard, a vice president at Berman & Company, were soliciting money from oil and gas executives for the Big Green Radicals effort, telling them that they needed to exploit fear, greed and anger, and to stoke resentment against environmentally-minded celebrities. The executive told the New York Times the presentation left a bad taste in his mouth.</p>
<p>
Last spring, that campaign placed billboards in a pair of states where the explosive growth of fracking has raised community opposition and demands for more regulation or banning the process altogether—Pennsylvania and Colorado. They mocked celebrities who had records of environmental advocacy such as Lady Gaga, Yoko Ono and Robert Redford. “Demands green living. Flies on private jets,” said the Redford Billboard.” “Would you take energy advice from a woman who wears a meat dress?” said the Lady Gaga billboard. The head-scratching billboard featuring Yoko Ono said, “Would you take energy advice from a woman who broke up the Beatles?”</p>
<p>
At the secretly taped presentation, Berman and Hubbard laid out their strategy of playing dirty, saying “You can win ugly or lose pretty.”</p>
<p>
Winning ugly is what he specializes in. The BigGreenRadicals website attacks big environmental groups like the Sierra Club, Food & Water Watch and the Natural Resources Defense Council, saying these organizations “have morphed into multi-million dollar lobbying machines that use questionable tactics to scare the American public and policymakers into supporting unnecessary and unreasonable policies.”</p>
<p>
Talk about the pot calling the kettle black!</p>
<p>
Even Robert F. Kennedy, Jr. chimed in on this one:</p>
<p>
And Sierra Club Executive Director Michael Brune said in a statement:</p>
<p>
“You know climate deniers and big polluters are desperate when they turn to the tired old tactics of the tobacco industry to try and save themselves. Whether it’s cigarettes or dirty fuels, toxic products are on their way out, and their proponents are left scraping the bottom of the barrel. Its not going to work—dirty tricks won’t save dirty fuels.”</p>
<p>
Berman told the executives at the June meeting that he had researched the personal histories of board members of these groups, looking for information that could be used to embarrass and discredit them. He emphasized to them how they could operate anonymously through his company, shoveling six-figure donations to his front groups without their involvement being revealed.</p>
<p>
“People always ask me one question all the time: ‘How do I know that I won’t be found out as a supporter of what you’re doing?’” Berman said. “We run all of this stuff through nonprofit organizations that are insulated from having to disclose donors. There is total anonymity. People don’t know who supports us.”</p>
<p>
They’re starting to learn, and that probably won’t work to Berman’s benefit.</p>

W YORK -- A front group for Washington, D.C.-based public relations firm Berman & Company is back with new targets: green buildings, green groups and the Environmental Protection Agency.
Berman & Co., helmed by Rick Berman (<a href="http://www.cbsnews.com/news/meet-rick-berman-aka-dr-evil/" target="hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">who was once called "Dr. Evil"</a><span class="Apple-converted-space"> </span>by CBS' "60 Minutes"), has a long history of running campaigns on behalf of the food and beverage industry under the banner of the<span class="Apple-converted-space"> </span><a href="http://www.consumerfreedom.com/" target="hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">Center for Consumer Freedom</a>. Earlier this year, CCF changed its name to the Center for Organizational Research & Education, according to<span class="Apple-converted-space"> </span><a href="http://big.assets.huffingtonpost.com/BermanCORECCF.pdf" target="hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">documents</a><span class="Apple-converted-space"> </span>filed with the Government of the District of Columbia and the North Carolina Secretary of State's Office, which were obtained by The Huffington Post. The group also recently launched the cleverly named<span class="Apple-converted-space"> </span><a href="http://environmentalpolicyalliance.org/" target="hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">Environmental Policy Alliance</a>, or EPA for short, a group "devoted to uncovering the funding and hidden agendas behind environmental activist groups."
An Environmental Policy Alliance spokesperson told HuffPost that the name change is part of a "restructuring" to "broaden the work that we're doing." The CCF will continue to exist, but alongside the "EPA" under the umbrella of the Center for Organizational Research & Education.
The new Environmental Policy Alliance appears to be one of Berman's first major forays into energy and environmental policy. The new "EPA"<span class="Apple-converted-space"> </span><a href="http://epafacts.com/" target="_hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">targets the U.S. Environmental Protection Agency</a>, which it deems "America's most powerful environmental activist."

CCF's Environmental Policy Alliance also launched a campaign called<span class="Apple-converted-space"> </span><a href="http://www.leedexposed.com/" target="_hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">"LEED Exposed"</a><span class="Apple-converted-space"> </span>last week, which critiques the usefulness of the U.S. Green Building Council's rating system for sustainability and efficiency of buildings. The group's "research" purports to show that "LEED-certified buildings use more energy and are more expensive" than uncertified buildings.
"This latest data release only confirms what we already knew: LEED certification is little more than a fancy plaque displayed by these 'green' buildings," Berman staffer Anastasia Swearingen said in a<span class="Apple-converted-space"> </span><a href="http://www.prnewswire.com/news-releases/leed-certification-fails-to-increase-energy-efficiency-says-environmental-policy-alliance-247899251.html" target="_hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">press release</a><span class="Apple-converted-space"> </span>announcing the launch of the campaign on Feb. 28.</p>

Swearingen<span class="Apple-converted-space"> </span><a href="http://www.forbes.com/sites/realspin/2013/12/13/those-green-schools-you-hear-about-arent-so-green-after-all/" target="_hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">also wrote an anti-LEED op-ed</a><span class="Apple-converted-space"> </span>for Forbes in December 2013, arguing, "we're clearly not spending that money wisely."
A closer look at LEED Exposed's methodology reveals a significant omission. The report concludes that, as a whole, LEED-certified buildings in Washington, D.C., use more energy than buildings without the certification. But the analysis only looks at the energy use of buildings relative to size, or what is known as<a href="http://www.energystar.gov/buildings/facility-owners-and-managers/existing-buildings/use-portfolio-manager/understand-metrics/what-energy" target="_hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">energy use intensity</a>.
EUI is only one of several recognized benchmarks used by building professionals to assess a building's efficiency, and looking at it in isolation ignores the importance of building density. Thus a large, abandoned building would score well for EUI, because its energy use is quite low relative to size.
"Their goal is just to confuse you," Scot Horst, the senior vice president of LEED at the U.S. Green Building Council, told HuffPost. Most Americans are unfamiliar with terms like energy use intensity, he explained, and may not fully grasp the complexities of assessing efficiency. EUI is "only a very partial snapshot of what's happening," according to Horst, and ignoring other measurements "leads to very unfair comparisons."
Groups like the American Chemistry Council and the U.S. Chamber of Commerce, which represent the wood, plastics and vinyl industries, have<span class="Apple-converted-space"> </span><a href="http://www.treehugger.com/green-architecture/leed-bashing-plastic-people-join-lumber-industry-trying-get-feds-drop-leed.html" target="_hplink" sl-processed="1" style=" box-sizing: border-box; color: rgb(57, 152, 0); text-decoration: none; line-height: inherit; margin: 0px; padding: 0px; border: 0px; vertical-align: baseline;">bashed LEED in the past</a>.
Swearingen told HuffPost that the alliance doesn't solely represent business interests, arguing that all Americans have a vested interest in affordable energy.
"Berman makes his money as a corporate hired gun, setting up front groups to denigrate public interest organizations that threaten his clients' bottom lines," Melanie Sloan, executive director for the nonprofit watchdog Citizens for Responsibility and Ethics in Washington told HuffPost. "I'm not surprised he's attacking groups and agencies focused on the environment, given the deep pockets of those interested in paying to stop climate change legislation and regulation."
"These methods of attack rely on the way people read media," Horst added. "They rely on creating confusion."

"This feeble attempt at a smear campaign is a good reminder to always consider the source," an NRDC spokesperson told HuffPost. "As opposed to this newly re-named front group, we've been around for decades. We cite our research. We sign our names on our materials. And we don't lurk in the shadows because there's no reason to hide our good work to protect our air, our water and our communities."</p>
