In our Republic there are only 3 “statuses”: inhabitants, the people, citizens.
The term “the people” are the ones with the power. Not “nationals”, not “citizens” and not the “inhabitants”. In our form of government we have the “free inhabitants” (Articles of Confederation/ Law of Nations”), “the people” and the public servants which are the “citizens”. We don’t have any other statuses. The word “national” didn’t even exist until 1878 after the Reconstruction Acts and the only place to find “national” is in the United States Code which are the corporate by-laws.
The free inhabitants and people are a different type of “citizen” in the sense that we are part of the Nation, we live here. We receive nothing from the State beyond protection of our life, securing our safety from foreign invasion, foreign enemies and internal insurrection. Tyrants are our declared enemy. Giving aid to our enemy is treason.
- All statuses under the civil law are a public office, a public right, and what the courts call “Publici Juris (public right)”
- A civil “status” is PROPERTY of the government.
- They have a right to regulate the use of THEIR property.
- Examples of “status” include:
- “taxpayer” under the tax code
- “driver” under the vehicle code
- “spouse” under the family code”
- “person”, “citizen”, or “resident” under civil law.
- Status under civil or franchise law is equivalent to “person” under contract law. In that sense, if someone put a contract in front of you that they signed, but you didn’t, the contract applies to “person” or “signators” or any number of different names for the people who sign the contract, then you have to sign the contract or act as though you consent to it in some way before you acquire the status of “person” under that contract. Government law behaves the same way. The government publishes their proposed contracts in the Federal Register to give notice to you of the conduct that makes you a consenting party to the contract or franchise.
- All government franchises are contracts between the government grantor and the applicant.
As a rule, franchises spring from contracts between the sovereign power and private citizens, made upon valuable considerations, for purposes of individual advantage as well as public benefit, and thus a franchise partakes of a double nature and character. So far as it affects or concerns the public, it is Publici Juris (public right) and is subject to governmental control. The legislature may prescribe the manner of granting it, to whom it may be granted, the conditions and terms upon which it may be held, and the duty of the grantee to the public in exercising it, and may also provide for its forfeiture upon the failure of the grantee to perform that duty. But when granted, it becomes the property of the grantee, and is a private right, subject only to the governmental control growing out of its other nature as publici juris. (Am. Jur. 2d. Legal Encyclopedia, Franchises 4: Generally)
- You cannot INVOKE or USE a “status” under the civil or franchise law or pursue a “benefit” associated the status without being SUBJECT to the civil law or franchise that CREATED that specific status.
- Pursuing the acquisition of a specific civil status by filling out a government application is the method of effectively consenting to the civil law or franchise that created the status.
An example is a driver’s license, it’s property of the grantor. When you apply for it you are asking for temporary custody of that property. While you have it you are held responsible for the duties of possessing it.
Government Theft by Status Abuse
- All franchises are implemented as a subset of the civil law and have domicile on the territory of the government grantor as a prerequisite.
- A de facto government is one that:
- Imputes a status to you that you do not have or do not consent to as a way to steal from you.
- Waives the domicile prerequisite to participation either by not putting it in the law or waiving it as a matter of policy.
- Is a corporation and not a body politic, all of whose “citizens and residents” are, in fact, public officers within the de facto government and franchisees.
- Imputes or presumes a status that you do not or cannot consent to. This violates due process of law.
- Interferes with your efforts to challenge their unconstitutional presumptions about your status.
