Habeas Corpus, Example

State is different than federal (federal makes you use their preset forms). The following is an example taken from the Sovereign Living video found attached. Only use what you feel comfortable with, as you must accept responsibility for your documents. In the video information is given on how to get assistance with your own form.

This is a non-statutory one, if you do it by statute you’re saying you’re one of the slaves. You don’t have to use this form, you can hand write it. You don’t have to use these court citations if you hand write it, but the arguments are the same. This is signed by the court clerk and then you serve it using the certificate of service on those who have detained someone in jail. As a friend, you can do one for a friend that’s in jail

In this example, there are 14 pages. The first four pages are the court document signed and stamped by the clerk, and the document served on the police. This may be hand written, in which case, leave out the court citations, except where it talks about Commercial Code 3.308, Commercial Code 1.206, Commercial Code 8.114.

You go to court with an original copy and at least two copies (you want a copy too). You serve the prosecutor and if there is more than one defendant, each must be served. Usually, it’s just one defendant because there’s only one jail. Get the clerk to sign and do all three; the clerk keeps the original. The certificate of service is filed into the case after you serve them.

The following example is for a right to travel violation:

The following example is a blank document served with the other paperwork for their response (if they want to use it). You don’t need copies of it.

The actual Habeus corpus claim (non-statutory) affidavit format. Add everything that’s true and correct and not hearsay.
