FACT CHECK: The Right-Wing Smear Campaign Against Mark Lloyd

By Amanda Terkel on Aug 22, 2009 at 11:16 am

Since the FCC appointed Mark Lloyd as the agency’s Chief Diversity Officer/Associate General Counsel on July 29, conservatives have made him their new target in the ongoing campaign to baselessly warn about the reemergence of the Fairness Doctrine.
The most absurd attacks have come from pundits like right-wing radio host Michael Savage, who has called Lloyd a “neo-Nazi” and “piece of garbage” intent on closing down “conservatives in the media.” He said that Lloyd’s title — Chief Diversity Officer — is “code word for the KGB.” For the record, Lloyd has a distinguished career on communications policy issues. Most recently he was a vice president at the Leadership Conference on Civil Rights and a senior fellow at the Center for American Progress. He taught communications policy at the Massachusetts Institute of Technology, served as general counsel to the Benton Foundation, worked as a communications attorney at a major D.C. law firm, and has nearly 20 years of experience in journalism.
The right wing’s main problem with Lloyd is a CAP/Free Press report he co-authored in 2007 called “The Structural Imbalance of Political Talk Radio.” The report’s authors explicitly state that they do not think the Fairness Doctrine should be reinstated, and Lloyd has since said that he has “no plans or interest” to resurrect the law. Nevertheless, conservatives are insisting that that goal is really Lloyd’s secret plan.
Unfortunately, Sen. Chuck Grassley (R-IA) has agreed to do the far right’s bidding. Last week, he wrote a letter to the FCC objecting to Lloyd’s appointment:

Simply put, I strongly disagree with Mr. Lloyd. I do not believe that more regulation, more taxes or fines, or increased government intervention in the commercial radio market will serve the public interest or further the goals of diversifying the marketplace. I am concerned that despite his statements that the Fairness Doctrine is unnecessary, Mr. Lloyd supports a backdoor method of furthering the goals of the Fairness Doctrine by other means.

These claims by Grassley and the right wing are misguided and based on a fundamental misreading — that may be either accidental or deliberate — of the report. A look at some of these myths:

– MYTH #1: Conservative voices will be kicked off the air. The report actually argues that telling radio broadcasters what to put on the air is inappropriate. What the report advocates for are policies that promote local programming, so what’s on the air is responsive to those communities and their advertisers, as opposed to national syndicators and large station group business models. Right now, the regulatory structure pushes out locally-owned, minority-owned, and female-owned stations. Grassley’s fear of “diversifying the marketplace” will not necessarily create more progressive talk radio; it may even get more conservative. It all depends on the on the location and interests of the community.

– MYTH #2: Lloyd wants to impose more taxes and fines on broadcasters. Grassley’s conception of taxes and fines is convoluted and out of context. The report argues that if broadcast stations don’t want to do local programming, they can pay a fine and get out of doing it. That money would go to the local public radio station for local programming.

– MYTH #3: Progressives secretly want a return to the Fairness Doctrine. Even Grassley admits that Lloyd never advocates a return to the Fairness Doctrine. Why? As Lloyd has explained, the Fairness Doctrine “never by itself fostered coverage of important issues in a way that spoke to the diversity of interests in local communities across our country. In the late 1960’s, the supposed golden age of the Fairness Doctrine, the Kerner Commission reported the failure of mainstream media to report on minority communities.”

Approximately 91 percent of weekday talk radio programming is conservative, and just nine percent is progressive. However, “43 percent of regular talk radio listeners identify as conservative, while 23 percent identify as liberal and 30 percent as moderate.” Much of this imbalance was created in the wave of consolidation after the Telecommunications Act of 1996, which “removed the national limit on the number of radio stations that one could own.” What progressives like Lloyd are advocating is not more liberalism, but more localism.

===
Mark Lloyd has devoted his long and distinguished public interest life to fighting for media diversity and free speech for all of us. In recognition of his career and expertise, he has been appointed Associate General Counsel at the FCC. Congratulations Mark! From all of us who served with you on the board of the Center for Democracy & Technology and all of those who have worked with you over the years.

Now Lloyd has been paid another honor: an attack from none other than Glenn Beck, one of our leading media voices of rage and distortion who spends his time 24/7 working to smear anyone associated with progressive policies.

Art Brodsky of Public Knowledge has written a careful deconstruction of Beck's distorted attack on Lloyd's character and public record to set the record straight and it is worth a read at for anyone interested in the facts and truth. Unfortunately, we don't think Beck or his followers are interested - but many will be.

The irony of this episode however does deserve mention. Lloyd helped to frame the legal and policy positions that has made cable programming more diverse and the Internet a true zone of free speech, unburdened from the regulatory regime that burdens traditional broadcasting. Lloyd has helped to give broad freedom of speech to everyone, including the Glen Becks of this world. And this is the reward he gets!

For those of us who worked for this open media, we can only suck it up and adhere to the principle of an open market place of ideas and support Lloyd as he continues to serve the public interest. The clash of ideas and distortions will go on. But in the end, Beckian lies and paranoid conspiracies will be shown to be just that.

Cultivating an open marketplace of ideas and diversity is a never-ending task, accomplished, in large part, by the wonderful tool of democracy called the Internet, a tool that holds no political allegiance. It's time to flex the muscle of this powerful, participatory tool to deflect attacks against those, like Lloyd, who fight, ironically enough, to ensure a culture of free expression that makes those very attacks possible.

We have to take a deep breath, redouble our commitment to First Principles of speech and association, and trust that in John Stuart Mill's famous formulation, truth in the end will prevail.

Van Jones is a gone pecan and the right wing libertarian movement led by the new de fecto head of the conservative party Glenn Beck smells blood . Fresh off the ousting of former special assistant for "green jobs" Van Jones Glenn Beck supporters are calling for the public lynching of FCC Diversity Czar Mark Lloyd . For conservatives to effectively target Mark Lloyd it looks like it will take more than it did to bounce Van Jones out of his position . Lets look into Mark Lloyd's back ground to see if there is enough rope.
-------------------------------------------------- Prologue to a Farce: Communications and Democracy in America. Drawing on a wealth of historical sources, Lloyd demonstrates that despite the persistent hope that a new technology (from the telegraph to the Internet) will rise to serve the needs of the republic, none have solved the fundamental problems created by corporate domination. In the book he presents the idea the private broadcasters (private business) should pay a licensing fees which equals their total operating costs so that public broadcasting station can spend the same on their operations as the private companies do. By doing so he hopes to improve the Corporation for Public Broadcasting currently at $400 Million for 2009.

Well the nitwit ideas of the left just keep on coming. At number 10 with a bullet is Mark Lloyd. The FCC Chief Diversity Officer is seeking to punish conservative radio broadcasters to increase the funding for NPR (Nitwit Public Radio) based on the surprise findings that 91% of talk radio programming is conservative and 9% is progressive (New word for Socialist).
The reason Mr. Lloyd can’t understand is because there is no market in progressive broadcasting and thus no profit. Private companies are in business to make a profit. Public broadcasting is not. Adopting this would silence a large portion of radio or at least create a few thousand oldies stations. Will the Christian stations have offer equal time to the non-Christian views and music? The progressive voice is heard when they call in and voice their views. No one is keeping them doing that. But when they do, most are ranting, make no sense and dodge questions. They are much like the dart throwers on conservative blogs. They come in, throw darts, call names, cuss and leave with a closed mind.
“The Corporation for Public Broadcasting (CPB) must be reformed along democratic lines and funded on a substantial level. Federal and regional broadcast operations and local stations should be funded at levels commensurate with or above those spending levels at which commercial operations are funded,” Lloyd wrote. “This funding should come from license fees charged to commercial broadcasters. Funding should not come from congressional appropriations. Sponsorship should be prohibited at all public broadcasters.”
In 2006 while at the liberal Center for American Progress Lloyd wrote a book entitled, Prologue to a Farce: Communications and Democracy in America.
Not only does he want to redistribute private profits, he wants to regulate much of the programming on these stations to make sure they focus on “diverse views” (Progressive Views) and government activities. I am all for that when I see on PBS a conservative voice next to Bill Moyers. And when I hear a conservative voice on NRP or just voice on NRP that sounds excited with some passion.
He suggests that large corporate broadcasting networks have driven liberals off of radio. His idea is that having diversity ownership will reflect diversity in programming. That is not true. Liberals drove themselves of radio because they have no ideas except doom and gloom and business owners do not want to be a part of that. Plus broadcast, like primetime television lives or dies based on ratings. Get low ratings and you are off the air.
Mark Lloyd FCC Chief Diversity Officer This is about control and tax revenue. It is not about diversity or equalizing the radio market. Mark Lloyd like most liberals wants to control our lives and what better way then with taxes. To punish a successful private business should be a crime.
