</div><div times="Times" new="New" roman="Roman" font-size="font-size" large="large" style="background-color: rgb(255, 255, 255);">On February 16, President Donald Trump signed an order to repeal the Stream Protection Rule. The Sierra Club noted that the rule covers waterways near surface coal mining operations including mountaintop-removal mines. The rule, introduced in 1983 and later strengthened by the Obama Administration, wrote that coal mines could not damage the “hydrologic balance” outside of their permit areas by doing things like dumping debris into valleys that could pollute rivers and streams with heavy metals such as selenium, mercury, and arsenic.32</div>=</div><div><div>=</div><div>related precursor?  see NMA</div><div>
</div><div><div class="entryDate" style="box-sizing: inherit; position: relative; padding: 0px 0px 0px 15px; margin: 0px 0px 2rem; line-height: 1.1; background-color: rgb(255, 255, 255);">BS july 11, 2019</div><div class="entryContent" style="box-sizing: inherit; background-color: rgb(255, 255, 255);">WASHINGTON, D.C. – Hal Quinn, National Mining Association (NMA) President and CEO, will today testify on the importance of the federal coal leasing program – a program that provides hundreds of millions of dollars of federal, state and local revenue per year, while providing a low cost, reliable source of energy for all Americans.In his remarks before the U.S. House of Representatives Natural Resources Committee, Subcommittee on Energy and Mineral Resources, Mr. Quinn said, in part:<blockquote style="box-sizing: inherit; position: relative; border: 0px !important; padding: 0px !important; margin: 0px !important;">The federal coal program has been a national energy and economic success story. It provides hundreds of millions of dollars of federal, state and local revenue per year, while also providing a low cost, reliable source of energy for all Americans.Unfortunately, in recent years, there have been misguided efforts to derail the program. The leasing moratorium announced in January 2016 by former Secretary of Interior Sally Jewell, for example, was based upon pretext and politics. None of the reasons she provided for taking such a drastic and disruptive action survive an encounter with the facts.The reasons offered for the moratorium are devoid of any real evidence, lack any analytical rigor and are simply a collection of the contrived claims both she and her predecessor previously rejected. Federal coal production provides a fair return to the public with almost $14 billion in federal royalties, acquisition fees and rentals paid between 2003-2014 alone. Some argue that federal royalties are too low. However, they are substantially higher than rates for private coal in the East, and federal coal producers also pay bonus bids and surface rentals. Federal, state and local governments receive about 38 cents of every dollar on the sale of each ton of coal produced in the Powder River Basin.If the Secretary really believed that certain issues with the program deserved further evaluation, nothing prevented her from proceeding to do so without imposing the drastic measure of halting coal leasing. And, this is what is so puzzling, to say the least, about a recent court ruling that the Department of Interior was obligated to conduct a NEPA analysis before Secretary Zinke’s order lifting the moratorium. It seems backwards.Following the court’s reasoning, if any action was subject to NEPA, it would be Secretary Jewell’s decision to halt leasing. The moratorium order was the classic leap first and promise to look later at the consequences. On the other hand, Secretary Zinke’s order merely ceased what Secretary Jewell characterized as a wholly voluntary programmatic review which, as all the evidence demonstrates, is unjustified and unnecessary.</blockquote>His full testimony as submitted can be found <a href="https://nma.org/wp-content/uploads/2019/07/Hal-Quinn-Federal-Coal-Program-Testimony-July-11-2019-Copy.pdf" style="box-sizing: inherit; background-color: transparent; text-decoration-line: none;">here</a>.BackgroundIn January 2016, former Secretary of the Interior Sally Jewell issued an order halting federal coal leasing while the Interior Department undertook a voluntary review of the coal leasing program and conducted a voluntary programmatic environmental impact statement (EIS).In March 2017, Trump administration Secretary of the Interior Ryan Zinke lifted the moratorium on coal leasing, ending the prior administration’s discretionary and exploratory process – a process that the agency itself started.  In lifting the temporary suspension, the agency took no actions that would trigger the National Environmental Policy Act (NEPA).In June 2018, the United States Court of Appeals for the District of Columbia Circuit agreed, ruling that the Interior Department was under no obligation to conduct a programmatic EIS on the program. The Department completed a programmatic EIS for the current coal leasing program and has continually conducted NEPA reviews for coal leasing on both regional and site-specific bases. Moreover, NEPA reviews are also conducted prior to any mining on a lease when the Department reviews the mine plan submitted by the mine operator under the Federal Coal Leasing Act.Unfortunately, in April 2019, in a sharp departure from precedent on the types of federal agency actions that trigger NEPA, a federal district court in Montana ruled that a NEPA review was required before former Sec. discontinuing a voluntary programmatic environmental analysis. This ruling not only contradicts the prior DC Circuit ruling, but ignores the fact that under the court’s reasoning the real action violating NEPA was former Secretary of Interior Sally Jewell’s order halting federal coal leasing, not Secretary Zinke’s action lifting the agency’s own voluntary pause on leasing. In February 2017, the Republican-controlled <a href="https://en.wikipedia.org/wiki/United_States_Congress" title="United States Congress" style="text-decoration-line: none; background: none;">Congress</a>, through the <a href="https://en.wikipedia.org/wiki/Congressional_Review_Act" title="Congressional Review Act" style="text-decoration-line: none; background: none;">Congressional Review Act</a>, passed a bill (a "resolution of disapproval") to revoke the rule. background: none;">[4]</a> Current evidence has linked coal mining with loss in stream water quality and ecosystem health.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-5" style="text-decoration-line: none; background: none;">[5]</a> State regulatory agencies have rarely enacted policy to regulate impact on streams outside of mining sites.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-6" style="text-decoration-line: none; background: none;">[6]</a>In July 2015 as part of the development of the new rules, OSMRE published a draft <a href="https://en.wikipedia.org/wiki/Environmental_Impact_Statement" class="mw-redirect" title="Environmental Impact Statement" style="text-decoration-line: none; background: none;">Environmental Impact Statement</a> about the new rules.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-EIS2015-7" style="text-decoration-line: none; background: none;">[7]</a> Pursuant to <a href="https://en.wikipedia.org/wiki/National_Environmental_Justice_Advisory_Council#Achievements" title="National Environmental Justice Advisory Council" style="text-decoration-line: none; background: none;">Executive Order 12898</a> issued by Bill Clinton, which required federal agencies to take <a href="https://en.wikipedia.org/wiki/Environmental_justice" title="Environmental justice" style="text-decoration-line: none; background: none;">environmental justice</a> (EJ) concerns into consideration when taking regulatory and other actions, and pursuant to the EPA's own guidelines for implementing that order finalized in 1998,<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-8" style="text-decoration-line: none; background: none;">[7]</a>: 4–317–330  The EPA studied the demographics of 286 coal-producing counties and identified 44 that had significant minority or low-income populations; half of those were in Appalachia.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-EIS2015-7" style="text-decoration-line: none; background: none;">United States Fish and Wildlife Service</a>; the <a href="https://en.wikipedia.org/wiki/Endangered_Species_Act_of_1973" title="Endangered Species Act of 1973" style="text-decoration-line: none; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; text-decoration-line: none;">environmental protection</a> and the nation's need for <a href="https://en.wikipedia.org/wiki/Coal" title="Coal" style="background-image: none; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; text-decoration-line: none;">coal</a> as a source of energy."<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-:1-13" style="text-decoration-line: none; background: none;">[13]</a> To achieve this, the rule included improvements in the protection of water supplies, water quality, streams, fish and other wildlife, and other environmental issues that are harmed by surface coal mining; furthermore, the rule provided mine operators with more regulations that would help avoid <a href="https://en.wikipedia.org/wiki/Water_pollution" title="Water pollution" style="background: none; text-decoration-line: none;">water pollution</a> as well as water treatment costs.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-:1-13" style="text-decoration-line: none; background: none;">[13]</a> In addition to these guidelines, the rule also included eradicating water pollution outside of permit areas, requiring thorough data collection for mining operations, protection and restoration of streams, updated guidelines for protecting <a href="https://en.wikipedia.org/wiki/Endangered_species" title="Endangered species" style="background-image: none; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial; text-decoration-line: none;">endangered species</a>, and long-term treatment of unintentional water contamination.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-:6-14" style="text-decoration-line: none; background: none;">[14]</a> Expanding on permits, the rule also guarantees that science and technology are leveraged to analyze the potential harms of mining. It also ensured that lands that are harmed by mining operations can be restored to a condition comparable to its condition before the mining operation was introduced.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-:1-13" style="text-decoration-line: none; background: none;">[13]</a> During the restoration process companies would be required to plant native trees and vegetation.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-:6-14" style="text-decoration-line: none; background: none;">[14]</a> 30% of the rule's provisions were revisions and organizational changes that aimed to help "improve consistency, clarity, accuracy, and ease of use."<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-:1-13" style="text-decoration-line: none; background: none;">[13]</a>Assistant Secretary for Land and Minerals Management, Hon. The report described the history of law, regulation, and litigation that had led to the new rules. The report also summarized a report, Draft Regulatory Impact Analysis of the Stream Protection Rule, that was prepared for the Interior Department's Office of Surface Mining Reclamation and Enforcement. That draft regulatory impact analysis (RIA) outlined the costs of the new rules to the coal mining industry, and provided an overall cost-benefit analysis of the rules.<a href="https://en.wikipedia.org/wiki/Stream_Protection_Rule#cite_note-CRS2017-3" style="text-decoration-line: none; background: none;">[3]</a> The draft RIA found that "added administrative costs resulting from the rule are expected to be small for industry, adding on average about $0.01 per ton of coal mined", although cost in Appalachia would be expected to be up to $0.04 per ton. Cost for small operators were expected to be higher. The draft RIA cites SMCRA Section 507(c) to assist these operators. The draft RIA expected administrative cost for government to range from $1,830 to $2,546 per mine depending on the region.
